Vinylitaly by Alberto Sabbatini ("Vinylitaly") invites users to read these General Terms and Conditions of Sale ("CGV") which govern the purchase of products and the management of orders placed on the site.
1. Conclusion of the contract and delivery of the products
1.1 Every order placed on www.vinylitaly.com implies the conclusion of a contract of sale between the buyer and Vinylitaly of Alberto Sabbatini ("Vinylitaly").
1.2 By clicking on the "Buy now" button, the customer places a binding order relating to the objects contained in the virtual cart. Once the order has been submitted, Vinylitaly will send the customer an e-mail confirming the order. The contract of sale is concluded between Vinylitaly and the customer when the latter receives the confirmation of the order. If the customer does not receive any confirmation of the order within the term indicated in this art. 1.2., The relative order must be considered rejected by Vinylitaly and, therefore, without effects.
Orders will be shipped as soon as Vinylitaly receives the total payment of the purchase price and any shipping costs. Therefore, Vinylitaly invites the customer to pay the price as soon as the order confirmation is received and in any case within 7 days.
1.3 Where products subject to the order are not available for reasons beyond the control of Vinylitaly, the latter must promptly notify the customer. In this case, there will be no obligation for Vinylitaly to deliver the ordered goods, except in the case where Vinylitaly has assumed the supply risk in relation to the products that form the order in question.
In any case, if the ordered products are not available, Vinylitaly will provide for any reimbursement, in favor of the customer, of any sum already paid, without any delay.
1.4 Vinylitaly does not assume the responsibility of having to search for and find unavailable products from other sources. This provision also applies to orders relating to fungible goods (for which only the type and characteristics of the products are described). Vinylitaly is only obliged to deliver what is available in stock and what has been ordered to its suppliers. The delivery time is expressed in working days, understood as all those included between Monday and Friday included, with the express exclusion of any public holidays.
2. Prices and shipping costs
2.1 The customer is required to pay the price published on the product page at the time the order is sent. The price indicated is final and inclusive of VAT.
2.2 The amount of shipping costs is indicated in the cart when the order is forwarded. These shipping costs are invoiced by Vinylitaly. In the event that the Customer returns the products in accordance with the procedure provided by this condition and by the applicable legislation, the shipping costs will not be reimbursed.
3.1 Vinylitaly accepts various payment methods including, for indicative purposes: credit card (through Paypal), bank transfer, Paypal.Vinylitaly reserves the right to refuse some payment methods and to request different payment methods for certain orders. The customer is responsible for any costs associated with the transaction.
3.2 The buyer agrees to receive invoices and credits exclusively in electronic format.
4. Right of withdrawal
The customer has the right to withdraw from any order without giving any reasons and with any declaration, provided explicit, delivered to Vinylitaly.
The right of withdrawal is however excluded in relation to purchases of:
- products made to measure or clearly personalized;
- sealed products that do not lend themselves to being returned for hygienic reasons or related to health protection, which have been opened after delivery.
4.1 Information regarding the right of withdrawal (pursuant to Article 49, paragraph 1, letter (h) of Legislative Decree No. 206/2005 "Consumer Code")
The customer has the right to withdraw from the contract, without giving any reason, within 14 days. The withdrawal period expires after 14 days from the day on which the customer or a third party other than the carrier and designated by the customer acquires physical possession of the last item ordered. In the case of a contract relating to multiple goods ordered by the customer in a single order and delivered separately, the term of 14 days starts from the day on which the customer or a third party other than the carrier designated by the latter acquires physical possession of the last good.
To exercise the right of withdrawal, it is necessary to inform Vinylitaly of the decision to withdraw from this contract by means of any explicit declaration to that effect (for example, with a letter sent by post, e-mail or telephone).
Vinylitaly will immediately send a confirmation of receipt of the withdrawal on a durable medium (for example via e-mail). The deadline set for withdrawal is considered to be met if the customer transmits his declaration before the 14-day deadline from the day on which the customer or a third party other than the carrier and designated by the customer acquires physical possession of the last well ordered. In the case of a contract relating to multiple goods ordered by the customer in a single order and delivered separately, the term of 14 days starts from the day on which the customer or a third party other than the carrier designated by the latter acquires physical possession of the last good.
4.2 Effects of withdrawal
Following the termination of this contract, Vinylitaly will reimburse all payments excluding delivery costs, without undue delay and in any case no later than 14 days from the day on which Vinylitaly gets back the asset. These refunds will be made:
- by crediting a Paypal account for payments made through this tool;
- by bank transfer in all other cases.
The reimbursement may be suspended until the receipt of the returned products by Vinylitaly or until the customer demonstrates that the goods have been shipped, if earlier.
The customer is required to return or deliver the products without undue delay and in any case within 14 days from the day on which he communicated his intention to withdraw from the purchase contract.
Products must be returned:
- correctly packed in their original packaging, not damaged, damaged or soiled and equipped with all the accessories, instructions for use and documentation. In the event of loss of the original packaging, the Customer shall, at his own expense, arrange for it to be replaced in order to be able to proceed with the return of the goods;
- with the transport document (present in the original packaging), in order to allow Vinylitaly to identify the customer (Order number, name, surname and address);
- without obvious signs of use, if not those compatible with the performance of a normal article test (they must not bear a trace of prolonged use or in any case exceed the time necessary for a test and must not be in a state that does not allow resale).
If the returned product does not comply with the provisions of the previous paragraph, or if the exception to the right of withdrawal indicated in paragraph 4 applies in relation to sealed products, the withdrawal will not be effective.
The costs of returning the goods are charged to the customer. The customer is responsible for any decrease in the value of the goods resulting from the handling of goods other than that necessary to establish the nature, characteristics and functioning of the products themselves.
Invoices will be issued exclusively in electronic format.
5.1 Refunds are credited to the customer as follows:
- through Paypal account for payments made by Paypal account;
- by bank transfer in all other cases.

7. Warranty for product defects and discrepancies and additional information
7.1 For the purchases made on Vinylitaly the rules of the Consumer Code are applied in terms of guarantee for product defects and discrepancies. The customer will therefore be granted the rights referred to in art. 130 of the Consumer Code and these rights must be exercised under the terms of art. 132 of the same Consumer Code.
7.2 These GCS can be consulted on the www.vinylitaly.com website and can be saved using the relevant browser command (usually, File -> Save as).
7.3 You can store the order details and download the GCS using the relative command of the browser to save the summary of the order that appears on the last screen of the purchase process, or waiting to receive the automatic order confirmation message that Vinylitaly sends via e-mail following the completion of the order. This confirmation message includes the details of the order and can easily be printed or saved using the functions provided by the e-mail programs.
8. Applicable law
8.1 The present GCS and purchase and sale contracts are governed by Italian law (and in particular by the Consumer Code - which in articles 46 to 67 govern distance contracts - and by Legislative Decree 70 of 09/04/2003 in the matter of electronic commerce) and in light of this they must be interpreted.
8.2 For any dispute that may arise in connection with the GCS and / or purchase and sale agreements, customers can activate an out-of-court dispute resolution procedure in accordance with the requirements set out in articles. 141 et seq. of the Consumer Code. In the event that the Client activates the aforementioned procedure, Vinylitaly guarantees its participation in an attempt to settle the dispute amicably.
